PRIVACY POLICY
AND SMS MESSAGING TERMS OF SERVICE

Information Collection: JND L.L.C. d/b/a Dana Rebecca Designs (“DRD”) is the sole owner of any information collected onDanaRebeccaDesigns.com website (“the Website”). DRD may collect information from users at several different points on the website. A user may potentially enter contact information (such as name, e-mail address, telephone number, and/or mailing address) in order to request a newsletter or catalog, to request additional information about one or more of DRD’s products, to opt into SMS messaging, or to purchase gift certificates. Similar contact information, further including credit card numbers, may be collected in order to process customer orders. Contact information collected may be stored in a database, and may be used for periodic catalog mailings, to send emails announcing items we believe of interest to our customers, and to respond to specific customer inquiries. By filling out our online forms, including our online order forms, users give consent to be contacted by DRD. Other types of personal data collected by the Website include hashed identifiers derived from email addresses for the purposes of cross-device tracking for targeted advertising. This policy also applies to personal information that we may receive from third parties, including third party marketing partners and data cooperatives. The Website is not intended for, nor does DRD knowingly collect information from, children under the age of 13. If a user asks DRD to remove us from a contact list, the user’s personal information will be flagged as “do not contact.” This information may be shared with certain third party service providers that we have engaged in order to assist us with operating the Website, issuing and redeeming gift certificates, and providing SMS messaging services. We may also share the personal information collected via the Website with third party marketing partners, and data cooperatives. These third party marketing partners and data cooperatives may use such personal information for their own marketing or other commercial purposes. If you prefer not to have your personal information shared with third parties, you may opt out of such sharing by emailing your request to privacy@danarebeccadesigns.com. If you would like us to delete your personal information from our records, you may do so at any time by emailing your request to privacy@danarebeccadesigns.com. We may transfer any or all of the information we collect to an affiliate, or to a successor of our business or assets.

Cookies; Third Party Service Provider Use of Data: DRD may set and access cookies on users’ computers for the purpose of maintaining an association between a user and items added by the user to a shopping cart for purchase, and for maintaining this association throughout order processing. DRD may also set and access a cookie from Google on users’ computers to enable what Google refers to as Google Analytics Demographics and Interest Reporting, enabling DRD to obtainuser demographic data including a user’s age, gender, language, and interests. DRD may use this data for general marketing knowledge, and to tailor our product offerings and advertising to better meet theneeds and interests of our customers. If you do not want DRD to have access to such demographic data about you, you may opt out here. In addition, when you visit the Website, third parties (such as AdRoll) may place cookies on your browser for targeted advertising purposes.Additional information on how AdRoll targeted advertising works may be found here. If you do not want to receive targeted advertising served by AdRoll, you may opt out here. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. Log Files: Like most websites, DRD (through its web host provider) uses log files. Logged information includes Internet Protocol (“IP”) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, number of clicks. This information is used internally by DRD to analyze trends, administer the site, track users’ movement on the Website in the aggregate, and gather broad demographic information. IP addresses are not linked to personally identifiable information.

Legal Disclaimer: DRD cannot ensure that personally identifiable information collected on the Website will never be disclosed in ways not otherwise described in this Privacy Policy. For example, DRD may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Though DRD makes every effort to preserve user privacy, DRD may be required to disclose personal information when required by law or when DRD has a good-faith belief that such action is necessary to comply with a subpoena, current judicial proceeding, court order or legal process served on DRD. Further, DRD can (and you authorize DRD to) disclose your personal information as DRD, in its sole discretion, believe necessary or appropriate in connection with an investigation of fraud or other unlawful activity.

California Residents Only: The California Consumer Privacy Act of 2018 (“CCPA”) is a law that addresses certain privacy rights of California consumers. The Website uses a third party service, namely AdRoll, for targeted marketing purposes. AdRoll’s disclosures to California residents of the categories of information that they collect, how that information may be used by AdRoll, and their rights and choices with respect to that information, may be found here. The Website uses another third party service, namely Hotjar, to create visual heatmaps of Website usage; to record visitor’s clicks, taps and mouse movements on the Website in order to improve the Website’s usability; and to analyze the use of the Website’s forms in order to improve user experiences. You may opt-out from having Hotjar collect your information when visiting the Website by visiting Hotjar’s Opt-out page and clicking ‘Disable Hotjar’.

SMS Messaging Terms of Service: The Dana Rebecca Designs mobile message service (the "Service") is operated by or on behalf of JND L.L.C. d/b/a Dana Rebecca Designs (“DRD”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any of our products. If you have opted in, the Service provides updates, alerts, and information (e.g., order updates, account alerts, etc.), promotions, specials, and other marketing offers (e.g., cart reminders)via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Reply with the single keyword command STOP to any of our messages to cancel at any time. You'll receive a one-time opt-out confirmation text message. For Service support or assistance, reply HELP to any of our text messages. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, that you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Notification of Changes: This privacy policy and SMS messaging terms of service is subject to change without notice. If DRD decides to change our privacy policy and SMS messaging terms of service materially, DRD will post those changes to this statement. Your continuing use of the Website and SMS messaging services after any update constitutes your agreement to our current privacy policy and SMS messaging terms of service.
